What is Probate and How Is The Realtors Commission Set During Probate?

Probate is a Superior Court procedure to determine a will’s validity and any creditor’s claims. Probate also establishes the identity of the beneficiaries. If the validity of a will is in question, then after a person dies, an administrator or administratrix is appointed by the court. The administrator of administratrix is appointed by the court to take possession of the property until probate is finalized. If the will has appointed a particular custodian, then that person is known as the executor or executrix. The real estate commission for a property that is in probate is set by a court order.

You Can Get The Home That You Want But You Have To Be Wise In Your Approach

What every agent and home buyer must realize is that when we look at homes, there are three homes. There is the fantasy home for the buyer. This is the home that they REALLY want but cannot afford. Next, there is the home that the home buyer thinks they would be willing to settle on. This is the home that may still be somewhat out of reach but with a few tweaks could lie within reality. Lastly, there is the home that the buyer is truly qualified to buy.

One of the very first things that must be dealt with is the fact that most of the time the buyers wants do not match the buyers economic position currently. There is nothing wrong with this. In fact it is just basic human nature. But if we look at home buying as a process, then we know that we must walk before we can run.

Once a buyer has been pre-qualified then they know what price range of homes that they can buy. But it is also in this revelation that buyers often come to realize that the type of home they ultimately envision is not in their price range.

Many buyers believe that the remedy to this is to look at the homes they want and then hope that a seller will take thousands of dollars less than the list price. Quite typically this approach only leads to discontentment and frustration. You can get the home that you want but you must be wise in your approach.

This means that if a buyer really only wants a certain home but that home is out of their price range then the first option may be to wait and save more money for a home. The next option would be to attempt to place offers on the homes that you want but understand that looking at homes that are significantly beyond your price range  is likely not going to be productive for you.

We can put in a lower offers and ask for other items but the truth is that you would have to be willing to put in offers on LOTS of homes and then see if any of them would be accepted. While this method tends to serve investors well, it is not generally the way the average homeowner wants to look for the home that they will want to live in.

The next method would be to figure out your five “must haves” and concentrate on attaining your “must have” features within your price range. Sometimes finding out that if we concentrate our efforts on the truly attainable items, we are likely to meet with success.

Questionable Marketing Almost Always Guarantees Questionable Results

We’ve heard the old adage about selling a home…put a sign in the yard, place it in the MLS and Pray! Truthfully, this is going on but it is probably due to not knowing any better. One thing my grandmother always said was, “When you know better, you do better!” One very crucial element of marketing a home for a successful sale is to figure out who the most likely buyer is. While out on an appointment today to evaluate a property, this lesson hit home.

This home was in a pretty poor location. It sat right in front of the freeway with a lovely brick wall view of the freeway. The noise? Oh no, it was really no bother at all to listen to the cars whizzing by every nano-second. The home sits on half an acre. And lo and behold in the smack, dab middle sat this home less than 1500 square feet big. Huh?

As I went inside, all I could think was, “Yikes”! I was there to provide a consultation as to the best marketing approach. Now, I have been known to put on my straight forward hat and tell people to just take a wrecking ball to things. Today was almost no exception. Well…almost!  As i toured the home, I thought, “Who wants this home?”

Well, first of all, one of the first things that was missed in marketing this home was to examine beyond trying to actually sell this home. Now are you wondering where I am going with this? The home is in MAJOR disrepair, tenants live in the home and it is not in the tidiest condition and I told you about the location. But wait….how about the zoning? The home is actually zoned to permit multi-family units, crops, elder care facilities, etc. Wow! With a little creative marketing, we can sell this property for more than what a single family home in the neighborhood is valued at. Yes, the value is in the land! Questionable Marketing Almost Always Guarantees Questionable Results. This is probably why the agent on this home had not seen much traffic and had not seen any offers. It is listed in the Multiple Listing Service under Residential Listings but it cold get a lot more mileage if we to some tweaking here.  With a very well researched and thought out home marketing plan…the results should be far less questionable.
